The following is the policy and procedure for the Geary County District Court Clerk’s office.
Access to the Clerk’s Office is limited to District Court personnel. All other persons are denied access until a request is made at the counter of what they need or with whom they need to speak. At that time, it will be determined if access is granted or if the Clerk’s Office can handle the request without giving access to the office.
All documents for the Judges should be delivered to the Judges’ secretary or to the Clerk’s Office or may be mailed to the Clerk’s Office.
A minimum fee of $1.00 will be assessed for making 1 to 4 copies. An additional 25¢ will be assessed for each copy made beyond the minimum fee charge. (Example: 1-4 copies = $1.00, 5 copies = $1.25, 6 copies = $1.50, etc.) The Clerk’s office has three business days to comply with the copy request.
If an attorney wants a copy of a court file, they are to check out the file and have it copied at their own expense. The file must be returned by hand delivery or mailing it by certified mail, return receipt requested.
If a member of the public wants a copy of a court file, there is a minimum charge of $12 per hour for research/clerical fees, in addition to the copy charge. Prepayment must be received before the copying will begin. The Clerk’s Office has three business days to comply with the copy request.
An attorney must provide the Clerk’s Office with enough copies for service upon the party, the sheriff, and a file-stamped copy (if requested). If enough copies are not provided, the attorney will be charged for the copy fees.
An attorney may check out a file from the Clerk’s Office for no more than 15 days. If a hearing or trial is set for that case, the file must be returned at least 3 days before the setting. The file must be returned by hand delivery or mailing it by certified mail, return receipt requested.
An attorney of record will receive two certified copies of a document at no charge. A fee of $1.00 will be assessed for any additional certified copy of such document.
A fee of 25¢ will be assessed for each page of a microfilmed document that is printed.
If an attorney requests that a file-stamped copy or a certified copy be returned to their office or sent to another office, a postage-prepaid, addressed envelope must be provided to the Clerk’s Office. Otherwise, the copy will not be returned. (If you request copies be returned in more than one case, please provide an envelope for each case.)
Any requests for information may be made by telephone, in person, or in writing. The Clerk’s Office will have three business days to respond to such request.
